Terms and Conditions

The following T’s & C’s apply to your purchase of 'Write Your Own Sales Page'.

 

This Agreement is between us — Jessica Larsen and any authorised team members of Hello Wordsmith (“us”, “we”, “Hello Wordsmith”) — and you (“The Buyer”, "The User") about your purchase of the Write Your Own Sales Page program (“WYOSP”, “The Program”).

 

1. Agreement

a) By purchasing The Program you understand that you are assenting to these terms and conditions.

b) You acknowledge that you are purchasing a single license for this program for your personal, individual use only.

 

2. The Program

“The Program” includes all materials, content, text and miscellanea comprising and related to Write Your Own Sales Page. This includes but is not limited to: the sales page for the program itself, the content of all lessons, all worksheets, videos, audios, downloads, interviews, the branding and design, the sales emails, the course emails, and all examples provided (except where otherwise specified).

 

3. Copying, Copyright, Unauthorised Distribution

a) Nothing in this program may be reproduced, redistributed, modified, published, transmitted, passed on, copied, used as teaching materials, or given to other people (clients, friends, colleagues or otherwise) without prior permission of the author.

b) Such permission must be explicit and in writing.

c) All the materials are for your personal use only and are not to be used in teaching, coaching, events, workshops, webinars, or elsewhere in your business (except for the purpose in which they are intended – to teach you to write your own sales page and sales copy).

d) All rights are reserved. Everything is the intellectual property of Jessica Larsen (except for photographs or where otherwise specified). And it’s all protected by law.

e) The terms and conditions regarding use of materials apply upon registration for the program, while you are taking the program, and upon and after completing, withdrawing from or terminating the program.

 

4. General Refunds (for Users who purchased the GENERAL guarantee)

a) Requests for refunds must be made within 30 days of purchase. Refund requests made outside of the 30 day period will be rejected.

b) Refund requests must be submitted via email to HeyThere (at) HelloWordsmith (dot) com

c) To be considered, requests must include the worksheet for Lesson 2, completed to a satisfactory level.

d) What constitutes a ‘satisfactory level’ will be determined by Hello Wordsmith in accordance with general standards of common sense and decency.

e) If approved, you will be notified via email. Hello Wordsmith will then refund your full purchase price within 10 business days (barring events outside of our control).

f) The amount to be refunded is the purchase price you paid.

g) Amounts will be refunded in Australian Dollars, except where otherwise agreed by the parties.

h) Hello Wordsmith cannot be held responsible for the delays of payment processors (including credit card companies, PayPal etc.). Where such delays occur, Hello Wordsmith will seek to notify you at the earliest possible convenience, and will transfer the money to you as soon as it has been released and/or processed by the payment processor.

i) Hello Wordsmith is not liable for any losses suffered due to such delays.

 

5. Extended Guarantee (for Users who purchased the EXTENDED guarantee during the special promotional period)

This section applies only to those who purchased the Extended Guarantee.

a)Requests for refunds must be made within 60 days of purchase. Refund requests made outside of the 60 day period will be rejected.

b) Refund requests must be submitted via email to HeyThere (at) HelloWordsmith (dot) com

c) To be considered, requests must include the worksheet for Lesson 2, completed to a satisfactory level.

d) What constitutes a ‘satisfactory level’ will be determined by Hello Wordsmith in accordance with general standards of common sense and decency.

6. The Sales Page Review Bonus

This section applies only to those who purchased the Bonus Sales Page Review.

a) The Bonus Sales Page Review ("Review") can only be redeemed by you, The Buyer, and is non-transferable.

b) You may submit one (1) sales page, up to 5,000 words in length.

c) Details on how to submit your sales page will be emailed to you at the email address you provided at the point of purchase.

d) You may not redeem your Review until AFTER the 30-day refund period has ended (unless by prior written agreement with us).

e) You must redeem your Review within 6 months of purchasing.

f) It is your responsibility to submit your sales page for review within the designated time period.

g) The Review will include feedback, advice and suggestions, but does not include any re-writing or edits.

h) When submitting your sales page, you will be required to fill out a short questionnaire, to enable us to effectively perform the Review.

i) We will endeavour to complete your Review and send it to you via email within five business days (excluding public holidays, weekends, vacation periods, sickness, etc.)

j) The Review is totally optional, but we encourage you to submit your work... even though we know it can be scary! 🙂

 

7. Membership Details

a) You are responsible for setting up your own password. Details as to how to do so will be sent to you in your Welcome email.

b) It is your responsibility to keep these login details safe and private.

c) Your access details may not be passed on to third parties. Passing your access details on to a third party means you will be in breach of this agreement.

d) If your email address or any other relevant details change, it is your responsibility to update those items in the membership portal.

 

8. Access and Technology

a) If there are any problems with the website or if the host/network should go down due to circumstances beyond our control, Hello Wordsmith shall not be held responsible. We will do our best to get the system back up as soon as possible when it is within our control.

b) Hello Wordsmith shall not be liable to you or any other party as a result of any viruses or malware that may infect your or any other party's electronic equipment.

c) You agree that you

i. Will not use any robot, spider or other device, process or means to access WYOSP

ii. Will not compromise or circumvent the security controls of WYOSP or otherwise gain unauthorized access to WYOSP

iii. Will not attempt to interfere with the proper working of WYOSP

 

9. Liability

a) To the extent not prohibited by law, Hello Wordsmith shall not be liable for any consequential, incidental, special or other indirect damages, such as lost profits, arising from the program, course materials or any actions or failure to act of Hello Wordsmith. In the event that Hello Wordsmith shall fail in accordance with these terms, Hello Wordsmith’s entire liability and the Buyer’s exclusive remedy for breach of these terms shall be to refund all payments actually received by Hello Wordsmith from the Buyer for the program. In no event shall the aggregate liability for damages of Hello Wordsmith arising from these terms whether by contract or tort exceed the amount/s the Buyer paid Hello Wordsmith.

b) We and our materials make no guarantee of results. You should not misinterpret the “6-figure” part of our framework's name to suggest you will experience a 6-figure launch when using it. In reality, the term “6-figure” represents the cumulative earnings we have achieved for our clients using the principles contained within this program. As with all training programs, your mileage may vary.

c) Where a testimonial suggests or states results of any kind, you should not expect the same results unless your business, efforts and resources are exactly as the testimonial-giver. We avoid forward-looking statements, but should you find one, it is intended to express our opinion of earnings potential.

d) In addition to the above, the Buyer specifically agrees that Hello Wordsmith DOES NOT:

i. Accept responsibility or liability for any loss suffered by the Buyer

ii. Assume responsibility or liability for the accuracy or completeness of content contained in the materials or links.

iii. Provide or arrange for any insurance for, or on behalf, of the Buyer

iv. Provide any indemnity for loss or injury suffered by the Buyer

v. Guarantee any results from this program, monetary or otherwise

vi. Guarantee continual access to the program, where such is outside of our control

 

10. Attestation

Hello Wordsmith reserves the right to

a) Terminate access to any buyer who does not abide by these terms and conditions.

b) Pursue legal actions where its rights have been willingly and unlawfully infringed.

c) Terminate access without notice to any buyer whose payment is declined or in some way retracted or denied.

 

11. Privacy Policy

Hello Wordsmith will not share your information with any third party without your consent, and it will only be used for administrative and notification purposes.

 

12. Lifetime of The Program

a) Hello Wordsmith reserves the right to cease providing, hosting or offering this Program at any time.

b) Should Hello Wordsmith decide to cease offering this Program, you will be notified via email and given the opportunity to access and download the materials (for you to keep for your personal use). It is your responsibility to do this. The materials will be kept online and available for a minimum of 30 days after the notification email has been sent.

c) If your email address has changed or you do not receive the email notifying you of this, Hello Wordsmith will not be held responsible.

 

13. No Waiver.

Our failure to enforce any part of these Terms of Service shall not constitute a waiver of our right to later enforce that or any other part of these Terms of Service. Waiver of compliance in any particular instance does not mean that we will waive compliance in the future. In order for any waiver of compliance with these Terms of Service to be binding, we must provide you with written notice of such waiver through one of our authorized representatives.

 

14. Other Provisions

a) When we communicate with you we will generally do so by email. You agree that email communications are contractually binding in the same way as properly signed and dated documentation sent by post.

b) Nothing in this agreement or on our websites (including http://www.hellowordsmith.com) shall confer on any third party any benefit or obligation.

c) If any of these terms is at any time held by any jurisdiction to be void, invalid or unenforceable, then it shall be treated as changed or reduced, only to the extent minimally necessary to bring it within the laws of that jurisdiction and to prevent it from being void and it shall be binding in that changed or reduced form. Subject to that, each provision shall be interpreted as severable and shall not in any way affect any other of these terms.

d) No waiver by us, in exercising any right, power or provision in this agreement shall operate as a waiver of any other right or of that same right at a future time; nor shall any delay in exercise of any power or right be interpreted as a waiver.

e) In the event of a dispute arising out of or in connection with these terms or any contract between you and us, then you agree to attempt to settle the dispute by engaging in good faith with us in a process of mediation before commencing arbitration or litigation.

f) We are not liable for any breach of our obligations resulting from causes beyond our reasonable control.

g) This Agreement shall be governed by and construed in accordance with the law of Queensland, Australia, and all international governance is expressly excluded.

h) You are deemed to have accepted these terms and conditions when you proceed with your purchase.

i) We reserve the right to update these terms and conditions at any time.
